I agree to follow the manufacturer's age recommendation Warning Label on the ATVor unit and that I am not purchasing the vehicle for anyone under the age recommendation on the vehicle warning label. I, the purchaser acknowledge and understand that riding an all-terrain-vehicle, Utility Vehicle, dirt-bike, go kart, motorcycle, moped, pocket gas scooter or other ridable vehicle kick scooter, E- Scooter, skate board, surf board, snow mobile and more is a dangerous activity that requires strenuous exercise and various degrees of skill and experience for individual riders. I the purchaser understands that these activities can result in serious injury to the person and can cause damages to property. I the purchaser voluntarily assume any and all risk associated with loss, damage or injury while riding the vehicles. I, am aware of the risks, hazards and dangers of personal injury, death and disability inherent with the specific use of these vehicles as well as the inherent risks, hazards and dangers of personal
injury and disability increase with inexperienced riders. I, as buyer, agree to release and discharge Phantom Powersports Inc and their agents, employees, officers, directors, trustees and all other persons or entities acting on their behalf and the manufacture from any and all claims, actions, damages, liabilities, cost or expenses and attorney fees which are related to, arise out of, or are in any way connected to your participation or use of these vehicles, equipment or property supplied by
Phantom Powersports Inc. or your presence upon the premises , whether or not such claims, actions, damages, liability, cost or expenses are caused by the negligence of the seller, manufacture or distributor. I, as the purchaser acknowledge and agree to be liable and pay for all court costs and attorney fees associated with any proceedings that may involve buyer, vehicle purchased, and Phantom Powersports Inc.

By this Agreement, it is my intention as the buyer, to surrender and waive any rights to sue or exercise any legal rights to seek damages from Phantom Powersports Inc. and their agents, servants, employees, officers, directors, trustees and all other persons or entities acting on their behalf.
This Agreement shall be affecting and binding upon my heirs, agents, personal representatives and assigns. I, have carefully read and acknowledge that I understand and agree to all the above Terms and Conditions. I have had the opportunity to ask any and all questions regarding this Agreement and the affect of the same. I, am aware that by purchasing this item and sending/remitting payment for it/them, I assume all risk, and waive and release certain substantial rights that I may have or possess.
I, as the purchaser, hereby certify that I have been informed of The ATV Rider Course, that is available nationwide.
Visit www.atvsafety.org and click on "Online Enrollment" or call 800-887-2887 to find the training program nearest to you.
I, as purchaser, agree Phantom Powersports Inc is not Liable for function and/or reliability of vehicle purchased, manufacturer's warranty decisions, vehicle itself, or any part associated with manufacturer vehicle and/or warranty.
I agree to read the user's manual carefully before operating my vehicle.
I agree to inspect my vehicle to be sure all nuts, bolts and chain are tight, tire pressure and fluid levels are good and the vehicle is safe for operations.
I agree to wear a helmet and protective gear when riding.
I acknowledge that it is my responsibility, to ascertain and obey all local, state and federal laws in regards to the possession and use of any items purchased from Phantom Powersports Inc.
Phantom Powersports Inc will not be liable for the misuse of any products purchased from Phantom Powersports Inc or any of its distributors or agents.
I have read this waiver of liability, assumption of risk and indemnity agreement, fully understand its terms, and understand that I, as buyer, am giving up substantial rights by agreeing to this waiver and have brought it freely and voluntarily without any inducement, assurance or guarantee being made to me. My purchase is to be considered as a complete an unconditional release of all liability to the greatest extent allowed by law.
In addition, I certify that I have read, fully understand, and agree to the terms of this Authorization, and I sign it voluntarily with the full knowledge of its significance

Shipping and Delivery

Assembled units will incur an additional shipping fee, certain states like NY,NJ, CT,RI,MA,ME,VT,NH,MI,CA,OR,WA may incur an additional $80.00 surcharge to remote areas or major cities, if this does occur you will receive an email or phone call notifying you. Assembled units being shipped will need to install the battery and will not come with gas, as it is illegal to ship this way. your unit will have been tested and tuned. turn key ready once the customer fills with premium gas and installs battery.

NO regular gasoline is to be used in these units. 93 octane

Your Unit will ship out within 3-5 business days if shipping from stores LI location and 7-12 business days if coming from the manufacturers location. Given the current situation with fuel/shipping delays. Assembled units can take up to an additional week before being sent out. Pre-order vehicles will be given a delivery window up to 2-3 months, for more info call or email.

The Freight company will Call and schedule your delivery. If you live in a remote area and the delivery truck can not get to you will need to make arrangement's with the shipping company.

If you are ordering in a crate it is most likely coming from the manufacturers warehouse this is in order to keep these units so affordable. If you have any questions call or email us.

Shipping is different from processing, processing does not mean your unit will be shipped with in 3-5 days. it means your order will be processed through the banking system and the manufacture will be updated that your payment has posted and they can send out your unit.

At this time, Off-Road and Outdoors ships merchandise to locations within the United States and U.S. territories, including Alaska, Hawaii, Puerto Rico, Guam, and the US Virgin Islands. Additionally, Off-Road and Outdoors ships merchandise to Canada , but not to other international locations. additional charges will occur for these areas, call store for more information before ordering, or your order may be canceled The risk of loss and title for all merchandise ordered on this Web site pass to you when the merchandise is delivered to the shipping carrier.

We do not ship internationally, We may be able to ship to Canada but call the store for details first.
